Terms of Use
These Terms of Use (“Terms”) govern your use of aimydecor.com (the “Site”), owned and operated by Giftmwah LLC, a limited liability company organized in the State of Wyoming (“Giftmwah,” “we,” “us”). By using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
1. Who may use the Site
The Site is offered to residents of the United States who are at least 18 years old, or at least 13 with a parent or guardian’s permission. We may limit or refuse access to anyone at any time.
2. What the Site does
You upload a photo of a room or outdoor space and choose a style and options. The Site uses third-party artificial-intelligence services to suggest products sold on Amazon.com and to generate an illustrative image showing those products in your space. You can add products to a cart and complete any purchase on Amazon.com.
The Site is a visualization and shopping-discovery tool. It is not an interior-design, architectural, engineering, electrical, or safety service, and nothing on the Site is professional advice.
3. AI-generated images and product information
- Rendered images are AI-generated illustrations. They may not accurately reflect the size, color, materials, fit, placement, or appearance of any product, or the dimensions and condition of your space. Always check product dimensions and specifications on Amazon before buying.
- Product listings, images, prices, ratings, and availability are supplied by Amazon at the time of your request and can change at any time. The information shown on Amazon.com at checkout controls.
- Products that affect safety — including pools, hot tubs, swing sets, play equipment, grills, fire pits, heaters, electrical and lighting items, and anything that must be anchored, installed, or inspected — must be selected, installed, and used according to the manufacturer’s instructions and all applicable laws, codes, and permits. The Site’s suggestions and images do not assess whether a product is safe, legal, or suitable for your space.
4. Purchases and affiliate relationship
We do not sell products. When you click a product link or “Buy on Amazon,” you leave the Site, and your purchase is a transaction between you and Amazon or the Amazon seller under Amazon’s terms, prices, shipping, and return policies. As an Amazon Associate, Giftmwah LLC earns from qualifying purchases. This does not change the price you pay.
5. Your photos and content
- You keep ownership of the photos you upload. You grant Giftmwah and its service providers a limited, non-exclusive license to copy, process, transmit, and modify your photo solely to create your design and operate the Site, and to retain cached results for the periods described in the Privacy Policy.
- You confirm that you own or have permission to use any photo you upload, that it shows a space you are entitled to photograph, and that it does not show identifiable people without their consent, private information, or unlawful content.
- Do not upload content that is illegal, infringing, defamatory, or harmful, or that depicts minors.
- You may use the rendered images you create for your own personal, non-commercial purposes. Rendered images may be shared for personal use (for example, with family or a contractor) but may not be presented as photographs of real products or real spaces.
- Marketing permission (optional). After a render you may tick a box allowing Giftmwah LLC to use your before photo and the AI render in marketing and advertising. If you do, you grant Giftmwah LLC a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, crop, and publish those two images, in any media now known or later developed, for promoting aimydecor and Giftmwah LLC — including its website, social media, paid advertisements, and other promotional materials — without payment, credit, or further approval. You confirm you have the right to grant this for the space shown. You may withdraw the permission for future uses at any time by emailing support@giftmwah.com (or by unticking the box in the same browser session); we will stop new uses within 30 days, but materials already published or in circulation may remain. Leaving the box unticked has no effect on your use of the Site.
6. Acceptable use and fair-use limits
The Site gives each visitor a limited number of free designs and renders per day. You agree not to:
- access the Site with bots, scripts, scrapers, or other automated means, or make automated requests to its interfaces;
- circumvent, disable, or interfere with usage limits, bot protection, geographic restrictions, or security features;
- copy, resell, frame, or redistribute the Site, its product data, or its design output as a service;
- use the Site to build a competing product or to train machine-learning models;
- interfere with the Site’s operation or impose an unreasonable load on it.
We may suspend or block access, delete cached results, and change limits at any time without notice.
7. Intellectual property
The Site, including its design, text, graphics, 3D animations, code, and the aimydecor name and logo, is owned by Giftmwah LLC or its licensors and is protected by copyright, trademark, and other laws. Product names, images, and trademarks shown on the Site belong to their respective owners. Amazon and the Amazon logo are trademarks of Amazon.com, Inc. or its affiliates.
8. Third-party services
The Site depends on services provided by Google, Amazon, and Cloudflare. We are not responsible for their availability, content, or practices, and your use of their services is governed by their own terms. Links to other websites are provided for convenience and do not imply endorsement.
9. Disclaimer of warranties
THE SITE AND ALL CONTENT, DESIGNS, IMAGES, AND PRODUCT INFORMATION ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DESIGN OR PRODUCT WILL MEET YOUR NEEDS OR FIT YOUR SPACE.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GIFTMWAH LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, OR FOR ANY PROPERTY DAMAGE OR PERSONAL INJURY ARISING FROM PRODUCTS YOU PURCHASE OR INSTALL, ARISING OUT OF OR RELATED TO THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED FIFTY U.S. DOLLARS ($50). Some states do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless Giftmwah LLC and its members, managers, employees, and service providers from any claims, damages, and expenses (including reasonable attorneys’ fees) arising from your photos or content, your use of the Site, or your violation of these Terms or any law.
12. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction. Either party may instead bring an individual claim in small-claims court. To the extent permitted by law, you agree to bring claims only in your individual capacity and not as part of a class or representative action.
13. Changes to the Site and these Terms
We may change or discontinue the Site, its features, free limits, or pricing at any time. We may update these Terms by posting a new version with a new “Last updated” date; your continued use after that date means you accept the updated Terms.
14. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, with the Privacy Policy, are the entire agreement between you and Giftmwah LLC regarding the Site. You may not assign these Terms; we may assign them to a successor.
